1. General statement and acceptance
This English version is provided for convenience. The Spanish text at https://yakuexperience.com/terminos governs in case of conflict. Peruvian law applies; courts of Ayacucho, Peru.
Yaku Experience (SULCA NEYRA KELVIN DEYNIS, Tax ID / RUC 10700879807, registered address Jr. Oswaldo N. Regal 116, Distrito Huanta, Provincia Huanta, Departamento Ayacucho, Perú) provides cultural, experiential and spiritual wellness tourism services under Peru’s Tourism Law No. 32392 and related regulations (including D.S. No. 002-2026-MINCETUR and D.S. No. 005-2020-MINCETUR), as applicable.
Where the experience includes ceremonial practices linked to traditional Ayahuasca use, that component is framed by National Directorial Resolution No. 836/INC (2008) (Cultural Heritage), without implying state health certification of our commercial activity.
Booking requires express electronic acceptance of these Terms (checkbox), valid under Civil Code art. 1374 et seq. Without acceptance, no reservation or seat is confirmed.
You declare legal capacity to contract. Minors may participate only with express authorization and accompaniment by a parent or legal guardian.
2. Admission and health screening
Before confirmation you must complete Yaku Experience’s Health Form truthfully, fully and under sworn declaration, including medical, psychiatric and cardiovascular history, medications, allergies and other relevant conditions.
Participation is expressly prohibited — unless we grant written authorization after individual review — for:
- Pregnant or breastfeeding persons.
- Persons with severe cardiac conditions, uncontrolled hypertension or prior stroke.
- Persons with severe psychiatric disorders (e.g. schizophrenia, bipolar disorder in acute phase, suicide risk).
- Persons on incompatible medication (including MAOIs and others listed on the Health Form).
2. (cont.) Right of admission and truthfulness
Yaku Experience reserves the right of admission and may refuse, condition or suspend participation where declared health or behaviour poses a risk to you or the group, without prejudice to the refund policy.
If you omit, conceal or falsify Health Form information, the Company is released from civil, criminal or administrative liability arising from that falsity, under Consumer Code Law No. 29571 arts. 1–3, without prejudice to the provider’s fitness duty (art. 19) for information we diligently manage.

You must read and follow the Preparation and Abstinence Guide at https://yakuexperience.com/preparacion, which forms part of the Company’s disclosed warnings.
Those indications are traditional preparation and general safety recommendations; they are not medical advice or a clinical protocol. Compliance and prior consultation with a licensed health professional are solely your responsibility.
Failure to follow the Guide may result in refusal, suspension or removal from participation under the right of admission and the applicable refund policy.
3. Non-medical nature and limitation of liability
Under General Health Law No. 26842, activities are not medical, psychiatric, psychological, pharmacological or clinical treatment and do not replace care by a licensed health professional.
No therapeutic or curative results are guaranteed. Any perceived benefit is personal and not medically certified.
You freely and knowingly assume inherent risks of the experience, releasing the Company, representatives and facilitators when ordinary diligence and disclosed warnings have been observed.
This clause does not waive liability for wilful misconduct, gross negligence or breach of non-waivable essential fitness duties under Law No. 29571.
4. Operations and logistics
Packages include (final detail in your booking confirmation):
- Basic / Express experience (1 day): transfers, prior guidance and guided session.
- Full / Immersive retreat (3 days): itinerary, wellness activities (grounding, guided meditation), lodging and session.
4. (cont.) Exclusions, transport and conduct
Exclusions: food not expressly listed in the confirmed itinerary is at your expense unless agreed in writing.
Transport: groups of five (5) or more receive private mobility; smaller groups may share transport as available. You must respect meeting times and points. Delay or absence does not create liability or free rescheduling.
Conduct: respect facilitators, participants and the environment; unauthorized substances, weapons or disrupting the ceremony may result in removal without refund.
5. Personal and sensitive data
Personal data, including sensitive health data on the Health Form, is processed under Law No. 29733 and its Regulation (D.S. No. 003-2013-JUS).
Purpose only: suitability assessment, reservation management and service delivery.
Reasonable security measures; no transfer to third parties without prior consent, except legal mandate.

6. Consumer rights and governing law
You have rights under Consumer Code Law No. 29571, including truthful information and fitness of the service as offered.
These Terms are governed by the laws of the Republic of Peru. Disputes: courts of the Judicial District of Ayacucho, Peru.
